ABSTRACT
This Article proposes expanding the legal academy's role in responding to disasters and emergencies, specifically through creating disaster clinics that take a communitybased lawyering approach. The Article is one of the first to identify the need for community-based disaster legal clinical education that goes beyond the immediate response phase. It also proposes creating a disaster legal pipeline from the clinic through post-graduation employment. The Article furthers the literature's discussion of the need for sustained disaster legal education. As the global pandemic caused by COVID-19 coronavirus continues to impact vulnerable populations and the frequency of natural disasters continues to increase, this Article provides a blueprint to law school faculty and administrators on the process of starting a new clinic or redesigning an existing clinic into a long-term disaster-related clinic. Additionally, the Article provides a timeline of disaster legislation that has evolved to provide a robust background for seminar courses. The Article draws from the author's expertise in creating two disaster clinics and multiple disaster and environmental justice courses. © 2023,Cleveland State Law Review. All Rights Reserved.
ABSTRACT
This paper aims to reflect on indigenous peoples' knowledge of nature and the way it may contribute to sustainability in the context of the ecological disaster of the COVID-19 pandemic. This study is justified given the current situation in which humanity finds itself, as the UN's assessment regarding the need to take care of nature, our "common home”, and the ancestral knowledge of indigenous peoples stands out. It is realized that the values preserved by the native peoples of the Americas, by contributing to the sustainability of the planet, could also help to improve the living conditions of present and future generations. © 2023 Universidad Nacional Autonoma de Mexico. ABSTRACT
This paper explores the relationship between epidemics and International Disaster Law. In particular the paper addresses some selective examples of legal and operational issues pertaining to International Disaster Law where the increasing concern on health emergencies, dated back to the Ebola crisis, have progressively facilitated the management of tailored initiatives. In particular, in relation to prevention and preparedness, challenges experienced to include biological hazards in universal disaster risk reduction frameworks will be introduced, as well as the dedicated attention to preparedness for epidemics progressively experienced in international coordination disaster management systems. In relation to post-hazard phases, some initiatives aimed at facilitating international relief operations in front of epidemics will be explored, as complemented by international financial instruments factoring epidemics in assistance programs. This overview might thus permit to assess some trends in this area, paving the way for potential further reforms eventually based on developments already introduced in the framework of the COVID-19 pandemic.
